Terms of sale



The general terms and conditions of sale for the purchase of alcohol-free wines (the "Products") displayed on the website www.nomora.it (the "Website") of Brand Zero S.r.l. (the "Seller"), are included in this sales contract (the "Contract"). Every user browsing the Website ("User") is invited to review the Contract before completing a purchase order for Products on the Website ("Order"); the submission of an Order implies the User's acceptance of the Contract. Any changes to the Contract will become immediately effective upon publication on the Website and will govern all subsequent Orders.


  1. Customers

    The completion of Orders on the Website is only permitted to individuals who have the legal capacity to enter into binding agreements under applicable law and who act for purposes unrelated to any business or professional activity they may carry out (the "Customers"). The sale of alcoholic beverages is not permitted to individuals who have not reached the legal drinking age. By placing an Order through the Website, the Customer guarantees that both the ordering party and, if different, the recipient of the Products are at least 18 years old. When required, Customers must provide their name, surname, date of birth, email address, delivery address, tax code, and other personal information. Such information must be true, accurate, and constantly updated. Users are encouraged to review the privacy policy to understand how and why the Seller processes personal data [link to Privacy Policy]. Users may not place Orders on the Website using another person’s name or credentials unless expressly authorized by the rightful owner. Users are encouraged to consult the Website’s Terms of Use in this regard [link to Terms of Use]. The purchase of Products for resale purposes is prohibited.


  2. Order Acceptance – Sales Contract 


    The technical steps for placing an Order are highlighted in the sequence of pages on the Website through explanatory texts and graphics. By clicking "Check-out" on the final checkout page, the Customer submits to the Seller a contractual purchase proposal for the items contained in the virtual "cart." The receipt of an Order does not constitute acceptance by the Seller of the contractual purchase proposal. To complete the Order, the following conditions must be met: (i) The Customer must read and accept the general terms and conditions of sale via a check box; (ii) The Customer must electronically fill out the Order form (the "Order Form"), which includes a summary of essential characteristics of each selected Product; the price of each selected Product and the total purchase amount; the chosen payment method; the delivery methods; shipping, delivery, and return costs; (iii) The Customer must make the payment to the Seller for the Products purchased, including any applicable shipping and delivery costs; (iv) The automated electronic submission of the Order Form to the Seller must be completed; (v) The Seller must receive the Order Form electronically. By submitting an Order, the Customer expressly acknowledges their obligation to pay the price. Following the electronic submission of an Order, the Customer will receive an email confirming the receipt of the Order. This communication serves to inform the Customer that the Order has been received and provides the Order identification code but does not imply acceptance of the Order by the Seller. If any data in the email is incorrect, the Customer must promptly notify the Seller’s customer service ("Customer Service") at info@nomora.it. The acceptance of the Order by the Seller occurs only when the Seller sends the Customer the Order acceptance confirmation ("Order Confirmation"), typically at the time of Product shipment. The relevant Contract is deemed concluded when the Customer receives the Order Confirmation. Until that moment, the Seller reserves the right not to accept an Order at its discretion. In particular, the Seller shall not be liable in the event that a Product ordered is removed from the Website after the Order has been submitted. It may happen that the Website mistakenly displays unavailable Products. In case of partial unavailability of an Order, Customer Service will contact the Customer to determine whether they wish to (i) receive a partial Order; (ii) receive the complete Order in multiple shipments; or (iii) cancel the Order. If the Order is completely unavailable, Customer Service will inform the Customer that the Order cannot be processed and will cancel the Order. In this case, no charges will be applied to the Customer. Images associated with each Product may occasionally differ slightly from the actual Product due to frequent changes by manufacturers in labels, capsules, or bottles.


  3. Payments

    Payments may be made through the following methods (the "Payment Methods"): credit cards, Satispay accounts, PayPal accounts. Accepted credit, debit, or prepaid cards include Visa, MasterCard, American Express, and Postepay. The Seller will charge the purchase price ("Price") at the time of Order acceptance. However, security checks on the selected Payment Method may be conducted before Order acceptance, including a pre-authorization or precautionary pre-charge. To ensure transaction security, the Seller uses a primary payment gateway for Order payment authorizations ("Payment Gateway"); therefore, the Seller does not directly manage any financial information related to the Customer’s Payment Method, nor does the Website process any financial information provided for completing the Order. Upon transaction completion, the Payment Gateway notifies the Seller of the payment outcome without providing financial details. The Payment Gateway encrypts sensitive card information to ensure secure transmission. The Website employs Secure Socket Layer (SSL) technology to enhance security on every Order. In the unlikely event of error, negligence, or fraud related to the payment transaction by the Payment Gateway or intermediary payment systems, the Seller shall not be held liable. The Seller reserves the right to cancel a transaction and annul the corresponding Order if fraudulent use of the Payment Method is detected. Additionally, the Seller shall not be held responsible for unauthorized use of a Payment Method by third parties beyond its control.
  1. Shipping and Delivery 

    The Seller ships and delivers Orders using an express courier service. The Seller is committed to delivering Orders to Customers promptly and accurately, in compliance with the delivery terms indicated on the Website at the time of purchase (24/48 working hours throughout Italy, except for the Islands where delivery times may be slightly longer) and, in any case, within 30 days from the date of sending the Order Confirmation to the Customer. The Order Confirmation is sent to the Customer when the Products are handed over to the courier for shipping. In certain circumstances, such as sales periods or company closures, delivery times may vary. The Seller cannot be held responsible for delivery delays not attributable to its fault or negligence. Therefore, the Seller shall be exempt from liability for delays due to force majeure, strikes, natural disasters, and any other events related to courier services or any other circumstances beyond its control. The Order Confirmation may include a tracking number that allows the Customer to monitor the shipping and delivery process of the Products on the courier’s website. The Customer is encouraged to do everything possible to facilitate the delivery of the Order, either by being available for receipt or by delegating it to third parties. The courier will attempt to deliver the Order to the address provided by the Customer. If delivery is unsuccessful, the courier will inform the Customer of the failed attempt and will try to arrange a new delivery of the Order. If the courier is ultimately unable to deliver the Order, Customer Service will contact the Customer to verify their interest in a new shipment. Upon delivery, the Customer must check the number of packages and the integrity of the external packaging. If the Customer identifies any delivery anomalies, such as discrepancies in the number of packages or damage to the external packaging, they must sign the courier’s delivery document with a reservation and contact Customer Service. If they fail to do so, the Customer may not later dispute the delivery, except as provided in Article 7 concerning hidden defects and in compliance with consumer protection laws. If the Products are not delivered within the indicated timeframes, the Customer must inform the Seller, who will verify the status of the shipment and any anomalies with the courier. In case of loss or destruction of the package containing the purchased Product(s) during transport, the Seller will either send a new shipment of the Product, subject to availability, or refund the Order. The Customer can contact Customer Service at info@nomora.it. The Seller cannot guarantee that Products purchased together will be delivered in a single shipment, nor that different shipments will arrive simultaneously. By selecting a different delivery country, prices, general conditions, and product availability may vary. For further information, please consult the “Shipping and Returns” section.


  2. Prices

    All prices published on the Website include VAT (the "Prices"). Regarding shipping costs for Orders (the "Shipping Costs"), the Customer should refer to the "Shipping and Returns" section. The amount of the Shipping Costs (if applicable), including VAT, will be visible in the Order summary during the checkout process and will be included in the Order Confirmation sent to the Customer upon acceptance of the Order. Any changes to Product Prices will take effect from the date of publication of the new Prices on the Website and will not apply retroactively to Orders already accepted with an Order Confirmation. Our discounted Prices are lower than the lowest price applied in the thirty days preceding the discount, which will be shown as a strikethrough price. Next to the strikethrough price, you will see the discounted Price, which is the Price at which we sell the Product. Except in the case of a recognizable error pursuant to Article 1431 of the Italian Civil Code, the Seller reserves the right not to accept an Order due to an incorrect Price published on the Website or indicated in the email confirming receipt of the Order, i.e., before the Order is accepted by the Seller.


  3. Promotional Codes

    During promotional campaigns, the Seller may provide Customers with vouchers and discount codes for purchasing Products exclusively on the Website. Vouchers are issued in the form of an alphanumeric code, and their value in euros is determined at the Seller’s sole discretion. The voucher can be entered by the Customer in the designated "voucher" field when placing an Order. The voucher amount will be automatically deducted from the total Order amount, excluding any Shipping Costs, before payment. Vouchers and discount codes issued by the Seller are non-refundable and non-cumulative.


  4. Non-Conforming Products - Legal Warranty

    Without prejudice to Article 4, the Seller is responsible for any original defects in the Products. The Seller guarantees that the Products sold are not defective and conform to the terms of the Contract, meaning that the Products: (i) Are suitable for the purpose for which goods of the same type are normally used; (ii) Match the description provided on the Website and possess the qualities of the Products presented to the Customer as a sample or model; (iii) Have the usual quality and performance expected of goods of the same type, considering their nature. For technological reasons, the Seller cannot guarantee that color display on the screen will always be accurate. Minor differences between the description of the Product on the Website and the actual Product characteristics will not be considered as non-conformities under this Contract. The warranty of conformity for Products sold on the Website lasts for 2 years from the date the Customer receives the Products. The sale of Products is governed by Articles 129, 130, and 132 of the Italian Consumer Code. If a non-conforming Product is delivered, the Customer must notify the Seller within two months of discovering the defect by sending an email to info@nomora.it. Once the notification is received, the Seller will contact the Customer to arrange the return of the Products at the Seller’s expense. Receiving the Products does not imply automatic recognition of a lack of conformity, as a thorough verification is required. If the defect is confirmed, the Seller will issue a purchase voucher equal to the purchase price of the non-conforming Product, which the Customer may use to replace the Product or select an alternative Product for a future Order. The action to enforce hidden defects expires 26 months after the Product’s delivery.


  5. Product Returns - Right of Withdrawal

    The Customer has 14 days from the Order’s delivery date to withdraw from the Contract, without penalties and without providing a reason, by returning the Product (“Withdrawal”). The date of delivery recorded in the courier’s tracking system will be used to verify compliance with this deadline. The Customer must notify the Seller of their intent to withdraw by contacting Customer Service at info@nomora.it. The Customer is responsible for proving compliance with the Withdrawal procedure. Returns must be made from the same country where the Products were delivered. If the Customer returns Products without meeting the conditions for Withdrawal, the Seller will not process a refund. The Seller will return the Product to the Customer and may charge additional delivery costs.


  6. Governing Law and Disputes

    These general terms and the related sales contracts are governed by Italian law. All disputes concerning these general terms and related sales contracts will be settled by the competent Court where the Customer resides, in accordance with applicable law. Out-of-court dispute resolution is also available as per Articles 66 and 141 of the Italian Consumer Code.


  7. Communications or Complaints

    For any communications, information, or complaints regarding an Order and these general sales terms, the Customer may contact Customer Service via email at info@nomora.it.


  8. Miscellaneous

    In this Contract, singular terms include plural and vice versa, depending on the context. If any provision of this Contract is deemed illegal, void, or ineffective, it will be considered severable and will not affect the validity of the remaining provisions.
